A and others v. Secretary of State for the Home Department, [2005] UKHL 71 was a unanimous decision of the House of Lords where it was held that evidence obtained by the government through torture is inadmissible in court. The decision overturned a Court of Appeal decison from 2002 where they held that such evidence could be used so long as it was obtained by those who were not agents of the British state.
The case began with 10 men who challenged a decision of the Special Immigration Appeals Commission to eject them from the country on the basis that there was evidence of them being a threat to national security.
