Family Law in Australia is primarily contained within the Family Law Act, 1975. This Act provides for divorce, children's orders, property division and spousal maintenance. The formalities of marriage are provided for in the Marriage Act 1961.

Since 1989 child support has been assessed under the Child Support (Assessment) Act, 1989 administered by the Child Support Agency Australia.

Children born to parents who are not married are still covered by the Family Law Act and Child Support scheme. However, the property division and spousal maintenance provisions of the Family Law Act only apply to people who are or have been married. Couples who have been in a de facto relationship must rely on the statutes of the various states and territories in which they live.

Child protection is also dealt with on a state and territory basis, under state and territory legislation.

Australia is a signatory to the Hague Convention on the Civil Aspects of International Child Abduction
