M. v. H. [1999] 2 S.C.R. 3 is a landmark decision of the Supreme Court of Canada on the rights of same-sex couples. The Court held that the exclusion of same-sex couples from the definition of "couples" under section 29 of the Ontario Family Law Act was in violation of equality rights under section 15(1) of the Canadian Charter of Rights and Freedoms and could not be saved under section 1 of the Charter. As a remedy, the Court struck down section 29 altogether rather than read in any necessary changes.
